StrataRater Terms and Conditions

  1.  Agreement to Terms
    By accessing or using the StrataRater website (“we”, “us”, or “our”), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use the Platform.
  2. Purpose of the Platform
    StrataRater is an online forum for individuals to share their experiences with Australian strata management companies. It is intended to promote transparency, accountability, and informed decision-making among property owners and residents.
  3. Eligibility
    You must be at least 18 years old to use StrataRater. By registering or submitting content, you warrant that you meet this requirement.
  4. User-Generated Content
  • All content submitted to StrataRater must be based on your genuine, personal experience.
  • You must not post anything that is false, misleading, defamatory, discriminatory, unlawful, or in breach of any third-party rights.
  • You remain solely responsible for the content you submit.

User Content must not include:

  • Content that infringes, or may infringe, the Intellectual Property Rights or other rights of any person;
  • Content that impersonates any person or entity or misrepresents your relationship with StrataRater or any other party;
  • Content that is false, unlawful, misleading, libellous, defamatory, slanderous, obscene, pornographic, indecent, lewd, abusive, harassing, or advocates harassment of another person, threatening, invasive of privacy, abusive, inflammatory, fraudulent or otherwise objectionable;
  • Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual, or which incites such behaviour or action from others;
  • Content that would constitute, encourage or promote, or provide instructions for the conduct of an illegal act or omission, any criminal activity, or violate the rights of any person or party in any country of the world;
  • Content that has been solicited by an incentive or payment originating from a strata company or a representative of their organisation;
  • Unsolicited promotions or SPAM;
  • Content which contains the private information of any person;
  • Content which publishes an image or likeness of a person who has not consented to their likeness or image being published on the Platform;
  • Content that is unrelated to the page of the Platform on which such content is posted; and/or
  • Content which contains viruses, malware or any other malicious software or data.
  1. Moderation and Removal
  • We reserve the right to edit, moderate, or remove any content at our sole discretion.
  • We may suspend or terminate user access if content violates these terms.
  • Content may be removed without notice if it is deemed inappropriate or legally risky.
  1. Reporting and Defamation Policy
  • We comply with the Defamation Act 2005 (NSW).
  • If you believe content on the Platform is false, defamatory or offensive, please contact us via our reporting form.
  • We will promptly review and investigate complaints.
  • Where appropriate, flagged parties will be notified and given the opportunity to respond.
  • Users who post unlawful or defamatory content may be personally liable under applicable law.
  1. Intellectual Property
  • Subject to clause 4, all content and information on the Platform, including but not limited to messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code or other material, as well as the infrastructure used to provide such content and information, is owned by StrataRater or its third-party licensors.
  • You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, code, products, or services obtained from or through the Platform.
  • Additionally, you agree not to:
    • Use the Platform or its contents for any commercial purpose, other than in your capacity as a genuine end-user;
    • Use another person’s name, account, identity or password without permission, or use the Platform while impersonating another person;
    • Access, monitor or copy any content or information of the Platform using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
    • Violate the restrictions in any robot exclusion headers or bypass or circumvent other measures employed to prevent or limit access to the Platform;
    • Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our server infrastructure;
    • Deep-link to any portion of the Platform for any purpose apart from where expressly permitted by these Terms;
    • Link directly to any page of the Platform from digital advertising platforms without our prior written consent;
    • Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used in connection with the Platform or its services, except to the extent specifically permitted by law.
  1. Privacy
    We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. This includes:
  • Only collecting personal information necessary for providing our services.
  • Notifying users about the collection, use, and disclosure of their information.
  • Taking reasonable steps to ensure personal information is accurate and up to date.
  • Providing secure data storage and restricting access to authorised personnel.
  • Offering users the right to access or correct their personal information.

  • StrataRater disclaims any and all liability for any loss, injury, claim, liability, or damage of any kind resulting from the use of, or the inability to use, the Platform.

    These Terms may be updated from time to time. Your continued use of the Platform constitutes acceptance of any changes.
  3. Governing Law
